4 NIMAS National Instructional Materials Accessibility Standard Standardized electronic file format used by textbook publishers facilitates the creation of accessible core instructional materials for students with disabilities.

6 Important Information Specialized formats do not include altering the content (i.e., the complexity) of the print instructional material. Instructional materials with copyrights prior to August 18, 2006, are not required to be placed in NIMAC by publishers. As a result, these titles will not be available through NIMAS/Florida.

It should be noted that specific eligibility requirements for students to access instructional materials derived from NIMAS files are more restrictive than special education eligibility requirements. Not all students with IEPs qualify to access these materials in specialized formats.

16 Copyright Code defines “Specialized Formats”? Section 121 (C)(3) of the Copyright Code (The Chafee Amendment) identifies three formats eligible for use by students qualified to benefit from the Chafee exemption:The Chafee Amendment o “'specialized formats' means Braille, audio, or digital text which is exclusively for use by blind or other persons with disabilities" (Copyright Law Amendment 1996, National Library Service Factsheets, Washington, DC, 2006). IDEA 2004 in Section 306(2)(c)(3)(B)(4)(B) modifies this statute to include large print as an allowable, “specialized” format: o “with respect to print instructional materials, includes large print formats when such materials are distributed exclusively for use by blind or other persons with disabilities.'‘
