Recalcitrant owners Tenements Act (Scotland 2004) –majority of owners can decide repairs and maintenance actions –an owner can apply to sheriff’s court to annul decision –Sheriff decides whether improvements/ alterations unfairly prejudice any owners/ or in their “best interests” Tenement title deeds prevail “No one feels happy pushing through an improvement against opposition”
