Maryland (1819) 1.Issue: National Bank 2.MD argued it had right to tax & BUS unconstitutional 3.Denied by Marshall, “The power to tax involves the power to destroy” B.Cohens v. Virginia (1821) 1.Issue: Lottery tickets 2.Marshall asserted right to review ALL cases. C.Gibbons v. Ogden (1824) 1.Issue: Steamboats a.Ogden (state has concurrent power) & Gibbons (feds have exclusive power) 2.Marshall ruled interstate rivers regulated by Congress

3 II. Protecting Property Rights Against States A.Fletcher v. Peck (1810) 1.Issue: Property Rights 2.Corrupt GA legislature grants land to Peck who sold to Fletcher but new GA legislature repealed! 3.Marshall rule sale was binding even if against popular will. B.Dartmouth College v. Woodward (1819) 1.Issue: Contract 2.NH tried to change Dartmouth’s charter 3.Marshall’s decision protected contracts against state encroachments.
