1 YOUTH IN GOV’T: JUDICIAL 2014-2015 SEASON

2 OVERVIEW Appellate Court: Court system which deals with legal challenges of the lower court’s decision (ex: unconstitutional ruling) Teams of 2-3 members Attorneys expected to write briefs & prepare oral arguments Case: Fisher v. University of Texas at Austin Affirmative Action and its relation to the 14 th Amendment Application of the Strict Scrutiny Standard

3 STRUCTURE Each team will get at least one opportunity to act as: Petitioner (Fisher) Respondent (University of Texas) Youth Justice Total of 9 Rounds Both the Petitioner and Respondent get 20 minutes to present oral arguments Petitioner speaks first and may reserve 5 minutes for rebuttal Respondent speaks second with no rebuttal Both attorneys must speak for at least 5 minutes per argument In teams of 3, one member must sit out each round of argument

4 BRIEFS Outline of planned argument One must be written for both sides Rough and final due on the same dates as bills Can be awarded Outstanding Brief Award Recommended that all team members work together on briefs, as opposed to splitting workload

5 ORAL ARGUMENTS 20 minutes per side, 40 minutes total per round Conversation between attorneys and justices Not adversarial Simply to gain a better understanding of the argument Flashcards, outline, brief, etc. may be brought to podium and used Recommended that attorneys: Rehearse ahead of time Listen to the actual oral arguments for all of the cases included in the Judicial Packet Plan how time will be divided ahead of time

6 JUDICIAL REVIEW Debate over constitutionality of Youth in Government bills Partners will be randomly assigned during Training and Elections Conference Time to prepare at Training and Elections Conference 3 rounds during the course of the Judicial Competition Friday evening Saturday afternoon Sunday morning

7 PRE-LEG EXPECTATIONS Judicial Packet completely read through Rough drafts of briefs written and submitted online Rough justice questions prepared Rough oral arguments drafted out Will have opportunity to meet with attorneys, practice oral arguments, and practice as justices Preparation is vital!

8 CONFERENCE EXPECTATIONS Judicial Packet completely read through Final briefs written and submitted online Justice questions prepared Oral arguments prepared and practiced At least some Judicial Review preparation Ready to work with others and have fun!

9 NATIONAL JUDICIAL COMPETITION Judicial’s version of CONA Trip to Chicago over the summer Up to 6 delegates selected to compete Very similar structure and rules to our competition Great opportunity and lots of fun!
