Good Morning We agree with the Coastal Commission’s report. We have worked closely and collaboratively with with CCC staff to find a workable solution. We thank them for their hard work. This process has taken 66 months, 41 with the county and 25 with the Coastal Commission.

There were never any disclosures about this lot not being suitable to build on. We made a conditional offer and did our due diligence. We showed a preliminary concept to David Holbrook, Senior Planner at the County of San Mateo and he stated our proposal appeared feasible…. Our response

Our lot was used as staging area for the construction of the bridge on the Mirada Surf Trail. We were asked by the contractor if they could use our land. We agreed. We thought we were doing something good to help the county. We personally never stockpiled dirt. There was never any additional clearing in 2009. Only grass cutting required by the HMB Fire department.

We disagree with our appellants proposal for us build a 900 sq. ft. home. This not why we are here and it’s not feasible given there is a county requirement for a 400 sq. ft. garage leaving only a 500 sq. ft. home. Our proposal is for a 2081 sq. ft. home that includes a garage on a 10,800 sq. ft. lot. Our lot coverage is 13%. Our response

By comparison our appellant’s (Evy Smith) home across the street is 2,400 sq. ft. on a 4,400 sq. ft. The lot coverage is 27%.
