Background February 11, 2014: Newport Beach City Council approves EIR July 11, 2014: CNB submittal for an amendment to CLUP July 23, 2014: Commission staff deems submittal incomplete October 9, 2014: CNB provides supplemental information October 24, 2014: Notice of complete CLUP amendment request issued by Commission staff December 11, 2014: Commission extended time limit for action; Executive Director indicated Summer or Fall 2015 for public hearing 4

Back Bay Landing Issues and Concerns 5 Change of Current Land Use from Recreational and Marine Commercial to Mixed Use Horizontal – Paves the way for residential development. – Will impact lower cost visitor and recreational facilities, and visitor serving opportunities. – Inconsistent with Coastal Act and City’s CLUP.

Issues and Concerns Piecemeal Changes to City’s CLUP Marina Park At the March 6, 2013 Coastal Commission Public Hearing, the City’s hired consultant stated that the Marina Park 73- foot tall faux light tower… “Clearly doesn’t represent precedent”, and “…..is clearly for this one architectural feature.” 6

Piecemeal Changes to City’s CLUP CLUP Policy 4.4.2-1 Maintain the 35-foot height limitation in the Shoreline Height Limitation Zone, as graphically depicted on Map 43, except for the following site: Marina Park. Marina Park located at 1600 West Balboa Blvd: A single up to maximum 73-foot tall faux lighthouse architectural tower…. may be allowed. No further exceptions to the height limit shall be allowed, including but not limited to, exceptions for architectural features, solar equipment or flag poles… CLUP Policy 4.4.2-1 amendment adds: Back Bay Landing at East Coast Highway/Bayside Drive: A single, up to 65-foot-tall coastal public viewing tower... 7

CLUP Amendment – Back Bay Landing Request for Public Hearing in October Public Hearing conducted Summer or Fall – August in Chula Vista (approx. 90 miles) – October in Long Beach (approx. 30 miles) Long Beach hearing location allows for greater public participation which is essential due to these and other concerns. 9
