Action on a Proposed Resolution Authorizing the City Manager to Execute a Concession Contract with American Legion Baseball of Janesville, WI to Operate a Concession stand at Veterans Field, Riverside Park File Resolution #2009-594 Leisure Services Department April 13, 2009

Background Legion has long history of baseball and concessions at Riverside Park Strong partnership with the City with hard work, donations and monetary contributions over the years

Proposed Contract Terms Lease until 2013 Legion responsible for providing concessions at: Games, leagues, or tournaments scheduled by the Recreation Division; Senior & Junior American Legion games; All school district high school games; and Janesville Aces games.

Proposed Contract Terms Legion makes annual improvements to Veteran’s Field with an associated value of $1,000 or greater or $500 check Legion holds at least one volunteer work day each year City receives no portion of their revenue

Recommendation Adopt File Resolution #2009-594 to authorize the City Manager to execute a concession contract with American Legion Baseball of Janesville, WI to operate a concession stand at Veterans Field in Riverside Park.

Background - 2008 Acquired Batting Cages property 1 year lease with Janesville Youth Baseball

Background - 2008 City responsible for mowing, utilities, property insurance, major pitching equipment repairs and property repairs JYB daily clean-up, small pitching equipment repairs, facility administration and liability & workers compensation insurance JYB paid City 10% of gross revenue City lost about $2,900 in 2008 Equipment & property repairs and supplies

Background - 2009 JYB desires the lease be renewed for 2009 Staff felt lease modifications needed Projected loss of about $4,200 using same terms JYB amenable to term changes

Proposed Contract Terms One year lease Renewable until 2012 City responsible for property insurance, mowing & trash pick up JYB responsible for utilities, supplies, equipment maintenance & facility admin JYB would not pay City portion of revenue

Recommendation Adopt File Resolution #2009-593 to authorize the City Manager to execute an operating lease with Janesville Youth Baseball, Inc. for the batting cage facility at 937 S. Jackson Street.
