3 doc.: IEEE 802.11-13/0934r0 Submission The Issue The FCC has allowed Progeny LMS to begin commercial operations of its multilateration location and monitoring service –“a highly accurate location service, which …will provide both precise outdoor and in-building location information, including improved delivery of E 911 emergency services” –They have yet to prove their actual value Transmits beacons in 904-909.75 MHz and 919.75-928 MHz –“…the Progeny system has an 80 percent duty cycle… Progeny's 30-watt transmissions would overwhelm the 1-watt transmissions used by numerous Part 15 devices” Progeny test results have not demonstrated acceptable interference –Many reports of interference in San Jose trial (BT, SmartGrid, Large Utility) Progeny system has not demonstrated location efficacy July 2013 Rich Kennedy, BlackBerry CorporationSlide 3

7 doc.: IEEE 802.11-13/0934r0 Submission 25+ Years of Unlicensed Use The 902-928 MHz unlicensed band provides enormous societal and economic benefits, fully justifying the FCC’s confidence almost 20 years ago in providing protection from unacceptable interference. If anything, the band is more important today than when it was first extended protection by the Commission. It’s equal or greater in importance than the 2.4 GHz “WiFi” band.

8 doc.: IEEE 802.11-13/0934r0 Submission The Coalition’s Position The Coalition fully supports the CSRIC Report’s suggestion to the FCC that further testing and study of E911 location systems takes place. Progeny/NextNav ‘s technology is a work in progress; the CSRIC Report states that Progeny will need at least a 2 nd generation system, since the present system does not meet public safety’s needs. While the Progeny/NextNav system is being developed, the FCC should not allow the company to operate a system that causes unacceptable interference to Part 15.

IEEE 802 has submitted several documents in opposition to the initial rulemaking and to the waiver which allows them to operate today We will continue to take every opportunity to oppose this –Work with the Part 15 Coalition; capture interference claims –Petition the FCC as the situation warrants July 2013 Rich Kennedy, BlackBerry CorporationSlide 9
