SECOND UNITS IN BRAMPTON BREB BUSINESS BREAKFAST October 8, 2015

As of April 22, 2015, Second Units are permitted in detached, semi-detached and townhouse dwellings, subject to zoning requirements and restrictions. Not every house in Brampton will be able to accommodate a Second Unit. A Second Unit is a self-contained residential unit located within a house, and it may be in any part of the house, including the basement.

In order to be legal, second units must be registered with the City of Brampton. Being in existence for several years doesn’t mean it is legal. The one-time registration process ensures a second unit meets all requirements under the Ontario Building Code or Fire Code, Electrical Safety Authority and Zoning By-law. Registration for Second Units began on June 22, 2015.

Registration Process Step 1. Apply for registration of a two-unit dwelling Requirements include: Complete application form Initial $200 fee Legal survey of the property Fully dimensioned Site Plan – Building setbacks, including setback to second unit entrance – Location of air conditioning units, accessory structures or encroachments in the side yards – Driveway length, width and configuration Floor Plans: ─Showing the location and layout of each unit ─Total floor area measurement for each unit

Registration Process Step 2. Zoning By-law Compliance – Only one second unit is permitted per house – At least one additional parking space measuring 2.7m x 5.4m must be provided for the second unit. Tandem spaces are permitted. – A side or rear yard entrance to the Second Unit must have a 1.2m clear path of travel.

Registration Process Step 2. Zoning By-law Compliance – A Second Unit can be up to 75% of the main unit’s GFA if the house is a bungalow. – For all other dwelling types, the Second Unit can be up to 45% of the main unit’s GFA.

Registration Process Step 3. Building Code Compliance (or) Fire Code Compliance (only for Legal Non-Conforming units) Fire inspection ($450 fee). Second unit to comply with Fire Code (upgrades may be required). A Building permit must be obtained if upgrades are necessary. Meeting the minimum standards for health and safety ensures appropriate: ─exiting ─early warning systems ─smoke and fire containment Submission of building permit for a change of use Inspections after each stage of construction Occupancy Permit

Registration Process Step 4. Final Registration Occupancy Permit and Electrical Safety Authority (ESA) inspection report OR Confirmation of compliance with Fire Code (includes ESA inspection) for Legal non-conforming units AND Verification of homeowner’s insurance Registration fee of $500 (owner occupied) or $1,000 (non- owner occupied)

As of September 22, 2015, the City has received 139 Registration Applications: – Applications cleared for Zoning Compliance: 98 – Applications for Building Permit: 26 – Building Permits issued: 14 – Construction and Registration complete: 0 Staff will report back to Council with updates/recommendations within one year of the policies being in place.
