8 8 Ag and PM 10 : Background Failure to address 24-hour average PM 10 violations in the 1994 Plan resulted in adverse Court of Appeals decision ADEQ developed “micro-scale” PM 10 plan in 1996 to address this issue Four sites with violating monitors evaluated Controls to remedy violations would apply throughout the nonattainment area

11 11 Ag and PM 10 : Background Attainment could be demonstrated at all sites except West Chandler As a result, EPA disapproved the plan in part, and, in April 1998, proposed a Federal Plan that included an Ag BMP program Arizona countered with legislation requiring ADEQ to adopt Ag BMP rules August 1998 Final Federal Plan did not include Ag BMP program

12 12 Ag and PM 10 : Background ADEQ, through the Ag BMPs Committee, developed current program Submitted to EPA in 2001, subsequently approved Approval upheld in 2004 Court decision

13 13 Agricultural Best Management Practices Applicability Commercial farms ≥10 acres All lands involved in farming: Crop land (includes fallow fields) Non-crop land (roads, staging areas) Tilling and harvest

14 14 Agricultural Best Management Practices Requirements Implement at least one BMP for each land type and activity Maintain a record of selected BMPs and make available upon request Noncompliance subjects farmer to acquiring an individual permit, which is enforceable under permitting statutes and rules

16 16 Agricultural Best Management Practices Yuma County Nonattainment for PM 10, but has 3 years of clean data (now) Redesignation derailed by a natural event; NEAP prepared that included an Ag BMPs program (under a separate rule) Maintenance plan submitted and awaiting approval
