Who is Marsy? Marsy’s Law is named after Marsalee “Marsy” Ann Nicholas. Marsy was a beautiful, vibrant University of California Santa Barbara student who was stalked and killed by her ex-boyfriend in 1983. Only a week after Marsy was murdered, her mother Marcella and her brother Nick walked into a grocery store after visiting her daughter’s grave and were confronted by the accused murderer. They had no idea that he had been released on bail. Marsy’s family’s story is typical of the pain and suffering that the family members of murder victims have endured. The Nicholas family was not informed because the courts and law enforcement, though well meaning, had no obligation to keep them informed.

Marsy’s Law for All Dr. Henry Nicholas, Marsy’s brother, has made it his mission in life to give victims and their families across the country constitutional protections and equal rights. Dr. Nicholas created Marsy’s Law for All in 2007. It is an organization dedicated to ensuring that victims of crime have an equal place in the criminal justice process. Marsy’s Law passed in California in 2008. Marsy’s Law passed in Illinois in 2014. Nevada Legislature passed resolution for Marsy’s Law in 2015. Marsy’s Law will be on the ballot in 6 states in 2016.

Why Do We Need Constitutional Amendment S in SD? Criminals in SD have constitutional rights, but their victims do not. Victims deserve equal constitutional rights. SD is one of the last remaining states that has no constitutional rights for crime victims and no automated victim notification system. SD has some of the weakest crime victim laws in the nation and victims do not have standing to have their rights enforced. SD Crime Victim Rights Act only applies to crimes of violence.

What will Constitutional Amendment S do? Marsy’s Law was developed in conjunction with legal experts and the National Crime Victims Law Institute to strengthen and expand rights for crime victims. Broadens definition of victim Due Process (Standing to make rights enforceable) Notification (Notification of Rights/ Notification for Criminal Procedure) Voice (Right to be heard) Right to documents Right to restitution
