3 Today’s Objective:  Begin to analyze the individual rights and freedoms granted by the 1 st amendment. 5.1.12.J – Analyze how the law promotes the common good and protects individual rights. 5.1.12.L – Analyze Pennsylvania and United States court decisions that have affected principles and ideals of government in civic life. 5.2.12.F – Evaluate how individual rights may conflict with or support the common good. 5.3.12.G – Evaluate how the government protects or curtails individual rights and analyze the impact of supporting or opposing those rights.

4 Last Thursday’s Intro Activity  How much freedom and privacy should we give up for security? Why do we give up so much?

5 1 st Amendment Congress shall make no law respecting an establishment of religion, or prohibiting the free exercise thereof; or abridging the freedom of speech, or of the press; or the right of the people peaceably to assemble, and to petition the government for a redress of grievances.

6 List the five basic liberties granted in the 1st Amendment: Religion Speech Press Assembly Petition

7 Freedom of Religion Explain the “establishment clause” Explain the “free exercise clause”

8 Speech Compare ‘libel’ to ‘slander’  Libel is the written or otherwise published, public defamation of a person or entity. Libel can include published photographs  Slander is the spoken false defamation of a person or entity. Slander can also include bodily gestures.  Defamation is any wrongful injury to the reputation of a person or entity.

9 Speech Why does the government restrict seditious speech? “words can be a weapon...” “if it causes a clear and present danger…

10 Schools banning political protests: Read ‘Tinker vs. Des Moines’ (page 559) and summarize the case: With what side do you agree – Tinker or the School District? Describe the Supreme Courts decision.

11 Does this change in 2006? How about personal websites or MySpace.com pages – does this change things?
