2 Interpretation? Clear: Article II, Section 5 –“Neither shall any person be eligible to that Office who shall not have attained to the Age of thirty-five Years” Vague: 1 st, 8 th Amendment –“Congress shall make no law…abridging the freedom of speech” –No Cruel and Unusual Punishment

3 2 Schools of Thought… Originalism –A legal document with plain words that should not change its meaning over time, no matter what the views of modern day judges are Living Constitution –Purposefully ambiguous (vague) and meant to adapt to changing times and the changing views of the nation.

4 Death Penalty – for teenagers Originalists – nothing in the Constitution forbids it Living Constitution –Laws should change with society’s changing views, Cruel and Unusual Punishment

5 Privacy Rights – abortion Originalists –abortion is not in the Constitution and laws should be decided by each state Living Constitutuion –The Federal Government has a responsibility to protect privacy
