Proposed LDC Amendments to Setbacks for Swimming Pools City Council December 1, 2015

Proposed Colorado Drive Pool Pool deck is 63’ from Columbia Lane but is not allowed as it would be in front of building façade. Zoning is SFR-2 with a 20’ front yard setback and 15’ side street setback. As proposed it would be “OK” if it met the minimum front yard setback distance of 20’ from Columbia Lane.

Proposed Pilgrim Drive Pool Pool deck is 39’ from Piller Lane but is not allowed as it would be in front of building façade. Zoning is SFR-3 with a 25’ front yard setback and 20’ side street setback. As proposed it would be “OK” if it met the minimum front yard setback distance of 25’ from Piller Lane.

New Text for Section 4.01.01.A. Location. Accessory structures, other than fences or as otherwise specified in this Code, shall not be located in public drainage or utility easements or within the required building setbacks. In addition, all accessory structures, other than fences, walls, arbors, trellises, pergolas, and detached garages or as otherwise specified in this Code, shall be located behind the front and side street building facades of the principal structure. However, on corner lots, swimming pools and their enclosures may be located in front of the side street building façade but shall meet the front yard setback requirements in lieu of the side street setback.

Recommendation Staff and the PLDRB recommend City Council adopt an ordinance to amend the Land Development Code for setbacks for swimming pools.
