2 DEVELOPMENT OF A WHITE PAPER ON CORRECTIONAL SERVICES Ministry of Correctional Services

3 PURPOSE OF THE PRESENTATION n To give a background on the origin of the White Paper n To inform the Portfolio Committee about the process of the White Paper n To ask for the involvement of Portfolio Committee members in the development of the White Paper

4 n Periodic review or revision of policies on Correctional Services in necessitated by: Ý Proper positioning within the Criminal Justice System Ý Identified Policy gaps Ý Changing needs of the South African Public (consultation and interaction with the community) Ý International developments in Management Philosophy, facilities design, construction concepts and financing vehicles. BACKGROUND ÝChanging environment in the political arena (alignment with Government Policy) Ý National and International trends in Corrections

5 The White Paper should : n n Provide a holistic approach towards Policy formulation which is much needed in the transformation of our correctional system. n n Inspired by practical considerations rather than theory alone. n n Deliver a guideline capable of being transformed into administrative practices supported by the relevant structures and operating within existing budgetary and human resources constraints and other inherent limitation. n n Respond to the present needs and circumstances of the Department whilst being sufficiently durable and long term.

6 n n First articulating and defining properly our unique background and circumstances. n n An in-depth analysis of challenges currently facing us within the context of the broader Criminal Justice System and Constitutional directives and principles. n n A rigorous examination and scrutiny of the Departmental and Criminal Justice Cluster initiatives currently being implemented. The Policy Development Process will focus on:

7 …….. continued n n An exercise to consolidate initiatives which have been proven to be effective into Departmental Policy. n n Integration of International experience and trends to consider further options in meetings our challenges as a Correctional Service. n n Cost effective facilities design to re-model existing facilities and development of new ones that are planned, programmed, designed and constructed to achieve targeted costs of construction, low operating costs, and substantially improving staff to inmate ratios.

8 …….. continued n Producing policies that will lead to the improvement of staffing ratios for guarding purposes and lowering of operating and maintenance costs, thereby releasing more resources into rehabilitation programmes. n Seeking to embrace the principles of restorative justice.

9 THE PROCESS n It is envisaged that a team of local and international experts will be brought in right at the beginning to consider all preliminary issues and develop a working document to serve as a basis for deliberations.  The process is broken down into aseries of tasks and sub- tasks that form a logical chain.  The process is broken down into a series of tasks and sub- tasks that form a logical chain.

10 The process broken down into series of tasks and sub-tasks: n TASK (A) Prepare a brief outline of the goals and objectives of the process: á Sub-task(1): in the context of the Constitution, á Sub-task(2): in the context of current SA circumstances within the criminal justice system, and specifically corrections, criminal justice system, and specifically corrections, á Sub-task(3): in the context of international best practices. n TASK (B) Secure agreement on the goals and objectives of the process: á Sub-task(1): in the context of corrections, á Sub-task(2): in the context of the justice system, á Sub-task(3): in the context of international best practices.

11 n TASK (C) Develop agenda for 2 workshops based upon agreed goals and objectives to be held : á Sub-task(1): with a limited group of local and international experts, given a focused programme for their input with key Ministry and Departmental officials, á Sub-task(2): with a limited group of key departmental officials, given focused programme for their input, á Sub-task(3): set tentative dates for conducting proposed workshops. n TASK (D) Prepare a list of potential participants at the workshops : á Sub-task(1): review and select a list of qualified experts with suitable credentials for workshop ‘1’, á Sub-task(2): review and select a list of key departmental participants for workshop ‘2’, á Sub-task(3): arrange invitations, funding and confirm availability of both international and local experts, á Sub-task(4): confirm dates and send appropriate notices and invitations.

12 n TASK (E) Conduct workshop ‘1’ : á Sub-task(1): define scope and purpose of workshop and stress the need to keep focused and aware of context, á Sub-task(2): following agenda, develop a clear structure as to who and how the conclusions of the workshop will be formulated, á Sub-task(3): formulate conclusions, and if appropriate, recommendations. n TASK (F) Submit the output of workshop ‘1’ to the Ministry and the Department for consideration : á Sub-task(1): seek general consensus and approval regarding conclusions of workshop ‘1’ from the Ministry, á Sub-task(2): based upon the accepted conclusions draft an interim set of conclusions for use in discussions with workshop ‘2’ group.

13 n TASK (G) Conduct workshop ‘2’: á Sub-task(1): define scope and purpose of workshop and stress the need to keep focused and aware of context, á Sub-task(2): following agenda, develop a clear structure as to who and how the conclusions of the workshop will be formulated, á Sub-task(3): formulate conclusions, and if appropriate recommendations. n TASK (H) Submit the output of workshop ‘2’ to the Ministry for consideration: á Sub-task(1): seek general consensus and approval regarding the conclusions of workshop ‘2’ from the Ministry.

14 n TASK (I) Develop a draft paper for consideration by the Ministry outlining the conclusions and incorporating the essentials agreed upon : á Sub-task(1): circulate draft as required and seek comment and input, á Sub-task(2): re-draft as required, á Sub-task(3): obtain inputs and comments from National Council for Correctional Services, á Sub-task(4): finalise draft paper (Green paper), á Sub-task(5): publish in Government Gazette for general information and comments by interested parties.

15 n TASK (J) The following tasks summarise the WHITE PAPER process; Undertake the White Paper process : á Sub-task(1): Minister appoints Task Team and a Chairperson (Normally the Head of Department) to consider the comments from the Green Paper and draft a White Paper, á Sub-task(2): drafting a White Paper, á Sub-task(3): submit to Portfolio Committee and publish in Government Gazette for public hearings, á Sub-task(4): finalise draft, á Sub-task(5): submit final draft to Cabinet for approval.

16 n TASK (K) An implementation phase will follow and may involve drafting of appropriate new legislation and regulations as well as development of departmental strategic implementation documents on at least the following issues : á Operations, á Programmes, á Facilities, design, construction, maintenance, á Financing and funding strategies, á Inter-departmental arrangements, á Capacity, population goals, profile and levels, n It would be the intention of these later phases to carry out the goals and objectives that are the policy outcomes of the White Paper process.
