2 Judicial Interpretation of the Constitution During this time, there were three major decisions: Marbury v Madison Gibbons v Ogden McCulloch v Maryland

3 FEDERALISM! (Separation of Powers)

4 McCulloch v Maryland 1819 Maryland decided to tax the federal bank (Hamilton’s plan)

5 McCulloch v Maryland McCulloch, a cashier for the bank refused to pay the tax State had no power or right to tax the federal government!

6 McCulloch v Maryland The Supreme Court agrees! Back off Maryland. Established the superiority of the federal government.
