2  Involve Maybank and NUBE  Started when employees feel dissatisfaction with management about the performance bonus.  NUBE published articles statements on Maybank website to express their dissatisfaction  Maybank sues NUBE regard the issue of defamatory statements.  Maybank also allow their employees to have in-house union(MAYNEU)  NUBE strike during the visit of Prime Minister and request Prime Minister helps to settle the dispute. 4 Maybank pay the employees about 2 months contractual bonus which is agrees by NUBE in the collective agreement earlier. They also paid the clerical and non- clerical employees RM750-RM1500 per employees. Decision to register in-house union (MAYNEU) is approve by the Minister of Human Resources and the Director-General of Trade Unions (DGTU) in 3 January 2011. NUBE should not put all the defamatory statement on Maybank websites which will influence their reputation and also the stakeholder’s confidence. 5 The court quashed the decision of the Director General of Trade Union (DGTU) which they should not develop an in house union According to Section 12, Trade Union Act 1959, (2) The Director General may refuse to register a trade union in respect of a particular establishment, trade, occupation or industry if he is satisfied that there is in existence atrade union representing the workmen in that particular establishment, trade, occupationor industry and it is not in the interest of the workmen concerned that there be another trade union in respect theoref. 6 The court has ordered Maybank to pay RM 30,000 to the two defendants (NUBE and Solomon). According to Section 22, Trade Union Act 1959, (1) A suit against a registered trade union or against any members or officers thereof on behalf of themselves and all other members of the trade union in respect of any tortious act alleged to have been committed by or on behalf of the trade union shall not be entertained by any court. 7 16 th Collective Agreement signed on 21.5.2014 Eligible employees will receive a salary adjustment of 10%. The starting pay for non-clericals and clerks would be raised by 18% and 12%. Existing monthly Cost of Living Allowance (COLA) will be revised from RM100 and RM 150 to RM200 and RM 300 respectively.
