Compliance - 22.03 22.03 (1)(c) Failure to comply with any term or condition of a permit, written approval, or order issued by the Department constitutes a violation. 22.03(14) Identifies minimum steps a PWS must take to reduce contaminants when the system exceeds a MassDEP health based standard 22.03 (15) DEP may request information from any person or entity

Construction, Operation and Maintenance – 22.04 22.04(4)(b) No person shall operate a public water system unless such operation is in accordance with the terms and conditions of all Department permits and approvals. 22.04(4) c) No person shall make changes to a treatment technique or remove a treatment device from service without prior notification to and approval by the Department.

Construction, Operation and Maintenance – 22.04 Cont’d 22.04(8)(b) (3)All new technologies approved by MassDEP must be capable of producing finished water that meets all federal and state maximum contaminant levels and drinking water standards 22.04(12) PWS must respond to sanitary survey deficiencies within 30 days of notification by MassDEP.

General Reporting - 22.15 Section 22.15 (c) Emergency reporting - Use 24 hour phone # 1-888-304-1133 if outside of business hours Section 22.15(8) Always use DEP reporting form to ensure compliance with annual statistic reporting requirements

Public Notification - 22.16 New violation requiring Tier II public notice Changes in corrosion control treatment practices that persist longer than seven (7) days Consult with DEP within 24 hour of learning of the violation Issue Public notice within 30 days of learning of the violation Other Situations requiring public notice -Table 6 Source water sample positive for Ground Water Rule fecal indicators: E.coli, enterococci, or colliphage Change or failure of treatment technique or practice (TT)

CCR- 22.16A 22.16A(12)(b A system may write its own educational statement, but only in consultation with and with written approval of the Department Distribution System -22.19 22.19(6) PWS must have up-to-date maps. Maps must be available upon DEP request

Surface Water Treatment Rule: Disinfection - 22.20A Failure to provide disinfection treatment on a daily basis is a treatment technique violation PWS must notify DEP within 24 hours of the failure to provide disinfection as required.

Sale, Transfer of Property Interest, or Change in Use of Water Supply Land -22.24 22.24(4) Notify the Department 30 days in advance of a property transfer, sale or system change.
