5  The Election of 1800  Republicans Jefferson and Burr  v. Federalists Adams and Pinkney  Republicans get power in Congress  Electoral Crisis #2 – Jefferson and Burr had same # of votes  On to the ….

6  House of Reps – 35 votes w/no success!  Hamilton persuaded some Feds to vote for Jefferson over Burr – he wins  Led to passage of 12 th amendment – 1804 – separate ballots must be cast for Pres. And VP  Eventually Burr and Hamilton duel and Hamilton is fatally wounded and dies….

7  Adams (Fed) appoints midnight judges before he leaves office  Jefferson (Pres.) orders Sec. of State Madison NOT to commission the judges  One judge, Marbury goes to the Supreme Court to ask for a writ of mandamus – an order by one branch to another…
