2. Introduction Constitutional & Mainland Affairs Bureau issued a “Consultation Paper on Stalking” in last December, inviting the public’s views on the proposed legislation against stalking. The consultation period ended in March, 2012. According to the consultation paper, stalking may be described as acts directed at a specific person which, taken together over a period of time, cause the person to feel harassed, alarmed or distressed. It is proposed that stalking should be made a criminal offence and subject to a maximum penalty of a fine of $100,000 and imprisonment for two years. After collecting public's opinions on "Legislating against Stalking", the Constitutional and Mainland Affairs Bureau will refine the proposal and submit to the Legislative Council in middle of 2013. Different stakeholders have responded to the consultation paper and expressed their views. One of the major concerns was how to protect individual rights (e.g. privacy) without interfering with freedom of the press. Studying the discussions among different stakeholders, we can think more about the contributions and limitations of legislation in terms of protecting people’s quality of life.
