Labor and management If collective bargaining doesn’t work, labor may strike It comes with risks … … but it is very effective Compromise can be reached through – Mediation: a settlement technique in which a neutral mediatory meets with each side to try to find a solution that both sides will accept – Arbitration: a settlement technique in which a third party reviews the case and imposes a decision that is legally binding for both sides

Mediation vs. arbitration MediationArbitration A helper, like a counselor May fail Both are methods of settling labor disputes Both use a neutral third party A helper, like a judge Will end in a decision Binding: Parties must abide by the decision

Strikes and lockouts Strike: an organized work stoppage, initiated by workers, intended to force an employer to address union demands Lockout: a temporary withholding or denial of employment during a labor dispute, initiated by management, in order to enforce terms of employment upon a group of employees.

Strikes vs. lockouts Strikes Workers are NOT eligible for unemployment benefits Workers can be replaced with permanent replacements Workers ARE eligible for unemployment benefits Workers can only be replaced with temporary replacements Both used when labor and management can’t agree Lockouts

Labor dispute profiles As you read the summaries and complete the handout, consider: – What issues are under dispute? Do you see patterns? – What tactics do management and labor use in each case? Why are they different? – In what ways did the parties work together? – In what ways did the parties work against each other? – How can disputes between management and labor best be managed? – Does one side have to lose for the other to win?
