7 Variance Requests The Application to Construct a Boat Ramp Facility includes three (3) variance requests: 1.Section 15-605(b)(8) (companion dock). The Code states, “No semi-private companion boat mooring dock shall exceed the length of the boat ramp (measured from the normal high water mark to the waterward end of the ramp) and a width of four (4) feet.” The proposed companion dock will be four feet wide, but will extend 25 feet beyond the end of the boat ramp. 2. Section 15-605(b)(20) (more than one ramp per subdivision). The Code states, “There shall be no more than one (1) boat ramp per subdivision or planned development.” The proposed boat ramp is within Phase 3 of Signature Lakes on Lake Speer. There is an existing semi- private boat ramp in Phase 2 of Signature Lakes that is located on Lake Hancock. The two lakes are not connected.

8 Variance Requests 3. Section 15-605(b)(14) (letter of credit). The Code requires, “the applicant to post a one-year irrevocable letter of credit, in favor of Orange County, in the amount of 10% of the assessed value of the boat ramp facility site...” The applicant proposes to post an irrevocable letter of credit or cash escrow in favor of Orange County in the amount of ten percent (10%) of the estimated cost to construct the boat ramp facility multiplied by 125%. The County has accepted this in the past. EPD supports the three variance requests.

14 Variance 3 Exhibit Code: The assessed value of the ramp parcel is $100.00. 10% of $100.00 = $10.00. Proposed: The estimated cost to construct the ramp is $69,721. (125% x $69,721 = $87,151) 10% x $87,151 = $8,715

15 Staff Report Conditions 17. A variance to Section 15-605(b)(8) (companion dock) is hereby granted to allow the companion dock to extend 25 feet beyond the end of the boat ramp. 18. A variance to Section 15-605(b)(20) (more than one ramp per subdivision) is hereby granted to allow an additional ramp within Signature Lakes Subdivision. 19. A variance to Section 15-605(b)(14) (letter of credit) is hereby granted. The applicant shall provide a letter of credit or cash escrow, in the amount of ten (10) percent of the cost to construct the boat ramp facility, multiplied by 125%, in favor of OC.
