1 COMPREHENSIVE BULLYING REPORTING SYSTEM FRANKLIN COUNTY SCHOOLS DR. BEVERLY L. JOSEPH ASSISTANT SUPERINDENTENT, STUDENT SERVICES

2 STUDENTS WITH DISABILITIES  There is no federal law specifically addressing bullying; therefore there is no legal definition under federal law.  The United States Department of Education recently issued a memorandum to the field addressing bullying of students with disabilities.  Children with disabilities are two to three times more likely to be bullied than their nondisabled peers. One study shows that 60 percent of students with disabilities report being bullied regularly compared with 25 percent of all students. National Bullying Prevention Center (2013).

3 DEFINING BULLYING BEHAVIOR  The behavior hurts, humiliates, or harms another person physically or emotionally.  Those targeted by the behavior have difficulty stopping the action directed at them, and struggle to defend themselves.  There is also a real or perceived “imbalance of power,” which is described as when the student with the bullying behavior has more “power,” either physically, socially, or emotionally, such as a higher social status, or is physically larger or emotionally intimidating.

4 HARASSMENT BASED ON DISABILITY  The Office for Civil Rights (OCR) and the Department of Justice (DOJ) have stated that bullying may also be considered harassment when it is based on a student’s race, color, national origin, sex, or disability.  Harassing behaviors may include:  Unwelcome conduct such as: Verbal abuse, such as name-calling, epithets, slurs  Graphic or written statements  Threats  Physical assault  Other conduct that may be physically threatening, harmful, or humiliating

5 DEFINITION BY NC GENERAL STATUTE  §NCGS 115C-407.15. Bullying and Harassing  Any pattern or gestures or written, electronic, or verbal communications, or any physical act or any threatening communication, that takes place on school property, at any school sponsored function, or on a school bus, and that:  (1)places a student or school employee in actual and reasonable fear of harm to his or her property; or  (2)creates or is certain to create a hostile environment by substantially interfering with or impairing a student’s educational performance, opportunities or benefits.
