2 I n t e g r i t y - S e r v i c e - E x c e l l e n c e Current National Policy Says National Space Policy, dated 28 Jun 10 states “A robust and competitive commercial space sector is vital to continued progress in space. The United States is committed to encouraging and facilitating the growth of a U.S. commercial space sector…” To promote a robust domestic commercial space industry, departments and agencies shall: “Ensure that United States Government space technology and infrastructure are made available for commercial use on a reimbursable, noninterference, and equitable basis to the maximum practical extent” U.S. Space Transportation Policy, dated 21 Dec 2004 directs us to “Encourage and facilitate the U.S. commercial space transportation industry to enhance the achievement of national security and civil space transportation objectives, benefit the U.S. economy, and increase the industry’s international competitiveness…” 2

Currently Titles 15 & 49 limit DoD to accepting reimbursement from commercial space companies for not currently required or underutilized (“excess”) capacity in the form of launch property, facilities, or direct charges for support services DoD is not allowed to accept non-DoD funding to enable or improve: Operation of commercial Space launch capabilities, Augmentation of DoD capabilities for commercial purposes, or Add commercial requirements to DoD contracts to extend/expand services in support of commercial Space launch activities 3 We Can Do Better But, That Requires a Change to Law

4 I n t e g r i t y - S e r v i c e - E x c e l l e n c e Change Title 10 to Enable Federal/Non-Federal Partnerships The proposed FY12 NDAA addition of Section 2275 “Commercial Space Launch Cooperation” to Title 10 will: Synchronize Title 10 with Title 15 (Commerce) and Title 49 (Transportation) Enable DoD partnerships with states and commercial users to: Increase capacity Share resources Combine resources Enable commercial space augmentation 4

5 I n t e g r i t y - S e r v i c e - E x c e l l e n c e Approval Process Senate Floor Vote (S 1253) - pending Full Conference - pending Congress Forwards Approved FY12 NDAA to President – late Nov President signs – early Dec (notional) 5

6 I n t e g r i t y - S e r v i c e - E x c e l l e n c e Next Step Systematically meet with Fed and Non-Fed (state and commercial) stakeholders to develop CSLC implementing language (DoD, Service, MAJCOM, Wing level, etc.) Mid Oct – OSD/EA4S/Service Framing meeting Nov – Dec – DoD Kick-off meeting HAF, AFSPC, 45 th SW, 30 th SW, Army, Navy, NRO Jan – DoD-Interagency Framing & Initial Drafting meeting DoD, DoT, NASA Feb – DoD + Industry Integration meeting Mar - May – DoD-Interagency/Industry follow-on meetings as needed 6
