History The idea or attempts at racial equality that exist in the US today have not always been so. Before the American Civil War the existence of slavery in the majority of Southern states was extremely common. The American Civil War will be fought for a number or reasons, one of which was the issue of slavery.

Emancipation Proclamation In 1863 Abraham Lincoln will free the slaves to the Union held areas of the Confederate States by an executive order. This would free 3.1 of roughly 4 million slaves at the time. The remainder of the slave population would be freed after the Union Army (US Army) successfully won the war.

Resulting Amendments 13 th Amendment: Legally abolishes slavery in the US (after Britain, Denmark, Norway, Haiti, West Africa, Mexico, Cuba, Estonia, Greece, Chile, Uruguay, Bolivia, Sweden, Argentina, Moldavia) 14 th Amendment: Legally makes, “persons born or naturalized to,” the United States citizens, and no state may make or enforces laws that abridge those rights. 15 th Amendment: Guarantees citizens the right to vote.

Plessy vs Ferguson 1890: Louisiana Railroad companies decide to separate white and black passengers on train cars. They find Homer Plessy, and octoroon [1/8 black], to buy a ticket and board the “white” section of the train. The company discovering he will do this allow him to board the train, ask him to move, and eventually have him arrested.

Plessy argues that his 13 th & 14 th Amendment rights are being violated, but a Louisiana court says the company is within its legal rights inside the state of LA. The decision will be fought up to the US Supreme Court where they judges will vote 7 to 1 in favor of the train company as long as the train cars are, “separate but equal.” This single ruling opens the door up to legalized segregation in the US.

The end of Separate but Equal Until 1954 the concept of “separate but equal,” is the law of the land. One day a man named Oliver Brown filed a law suit stating that the separate black school attended by his daughter was not “equal” to that of the closer white schools, and that she should be able to attend the closer/better school So started Brown vs. Board of Education

The case of Brown will be fought up to the Supreme Court and combined with a number of other cases arguing the same matter in different states. In 1953 the Justices will vote 9-0 in favor of Brown, and legally end segregation. Though the law of separate but equal comes down in 1953 it is not accepted in areas where racial tension is prevalent. This will lead to the Civil Rights Movement.
