Committee Agenda Subcommittee met on September 23, 2015. 5 states and EPA Regions 4 & 5 represented. Agenda: ORSANCO’s review of draft permits and status of permits on file at ORSANCO. Updates to Subcommittee ○ proposed standards revisions/comments ○ mercury variances requests received by ORSANCO Impacts of US EPA Revised Criteria on Permitting Programs 316(b) Rule Implementation Issues and Role ORSANCO

ORSANCO Permit Reviews Staff maintains a docket file of NPDES permits issued to Ohio River dischargers. Draft permits are reviewed to ensure compliance with Commission standards. ORSANCO’s files need to be updated with current permits. Staff is working with the states to update files and ensure future permits are sent to ORSANCO.

Proposed Changes to PCS Staff provided an update on the proposed changes to the Commission’s Pollution Control Standards and variance requests PCS changes discussed include: Mixing Zone Prohibition for BCCs ○ Replacing the October 2015 deadline with “as soon as practicable” and transferring its determination to the states. Adding EPA’s aquatic life criteria for ammonia ○ Tables for mussels present will be default criteria; however, mussel absent criteria tables will be included as well. ○ Question was raised regarding process to demonstrate mussels absent. Variance Requests Koppers, Mountain State Carbon, Valley Converting Discussed possible Commission action on variance requests depending on decision regarding mixing zone prohibition

Other Issues Impacts of USEPA’s Revised Criteria on Permitting Are states planning to adopt new criteria and what impacts might this have on permitting? Still too early to determine. Coordination of 316(b) Reviews New Federal rules require comprehensive reports and studies regarding adverse impacts from impingement and entrainment of aquatic organisms. Affects Approximately 544 power plants and 521 manufacturing facilities nationally ORSANCO Role ○ Issues Specific to Ohio River and Ohio River Facilities ORSANCO comment on biological studies Maintain repository reports/studies and individual state decisions on 316(b) Issues NPDES Subcommittee - forum for discussion
