3 what is civil law? deals with non criminal matters involving disputes between individuals and organisations such as breaches of contract where criminal law involves doing something that is consider to be an offence, civil law deals with injustices where a person suffers through another person’s actions – negligence How do court decides negligence? Test: what a reasonable person would/would not do

4 definitions contract – an agreement, between 2 more parties that is intended to be enforceable by law. Contracts can be written or verbal; express or implied Liability - a duty, obligation or responsibility, as applied in the law Negligence - when a person or organisation fails to exercise reasonable care and causes damage to another person Damages - compensation for injury or loss

5 Contracts and young people Can young people enter into contracts? Are they binding and enforcable? Answer: young people can enter into contracts that are needed to sustain them Student Activity Identify whether contracts entered into by people,<18 years old are enforceable: rental agreement education Car expensive stereo equipment

6 Criminal or civil? How can some cases give rise to proceedings under both criminal and civil law? Eg: Doomadgee death-in-custody case 2004 criminal actions against Sgt Chris Hurley civil case for damages (victim of crime compensation awarded 2011) Student Activitiy – Identify a hypothetical situation in which a victim can bring actions under both criminal and civil law
